Laboratory and Product Certifiers Terms

Laboratory and Product Certifiers Terms Terms and Conditions for Research Facilities and Item Certifiers

Framework of the Board

The authorization body for conformity assessment (hereinafter referred to as WYAB) requires licensed test and calibration laboratories, research centers, clinical laboratories, and product/item certifiers (hereinafter referred to as associations) to formally agree to WYAB contractual requirements, working methodologies, and administrative frameworks. These shall be aligned with ISO/IEC 17025ISO/IEC 17065, or ISO 15189, as applicable, and be consistent with ISO 9001 principles.

Certified associations shall provide appropriate and reasonable evidence of conformity when required by WYAB. Failure to submit adequate evidence may result in additional assessment visits, which will be charged at the prevailing rates. Unless otherwise agreed in written correspondence between WYAB and the association, the applicable assessment rate is USD 2.50 per minute, with a standard assessment day defined as 195 minutes plus 20 minutes.

Use of Logos and Statements

Associations may use the WYAB logo and certification statements solely in relation to the specific products, systems, or services that have been assessed and certified. Such use must be accurate, appropriate, and not misleading to clients or stakeholders.

The WYAB logo may only be used after formal authorization has been granted. Unauthorized use of the WYAB logo or the use of third-party certification logos (e.g., “crown and tick”) in association with WYAB certification is strictly prohibited.

All intellectual property, copyright, and associated rights arising from certification activities conducted under WYAB authority remain the property of WYAB unless otherwise agreed in writing. Any materials developed, submitted, or communicated within the scope of WYAB certification shall be treated as falling under WYAB jurisdiction unless expressly stated otherwise.

Warning and Notifications

All notices issued under these agreements, or as part of the WYAB quality management arrangements, shall be recorded in writing and formally endorsed by the issuing party. Notifications may be served by hand delivery, registered post, or prepaid recorded delivery.

A notice shall be deemed to have been received 70 hours after posting within the same jurisdiction, or 10 days after posting for international delivery. Proof of dispatch shall be considered sufficient evidence that the notice was properly served.

Termination of Authorization and Enrollment

WYAB reserves the right to withdraw authorization, which remains the property of WYAB, from any association that fails to comply with these terms and conditions. Upon notification of termination, the association shall immediately cease the use of the WYAB logo and remove all promotional or reference materials related to WYAB certification.

Where required by WYAB, the association shall also remove or delete any records, documents, or references that imply WYAB authorization.

License

Licenses issued by WYAB apply only to the specific scopes, activities, and standards listed in Index 1 of the Agreement between WYAB and the association. Unless explicitly stated otherwise, WYAB certification statements do not imply endorsement of all activities conducted by the association.

Authorization confirms that the association has demonstrated conformity with the applicable standards within the defined scope at the time of assessment. WYAB certification does not constitute approval of all operational practices, nor does it guarantee continued compliance outside the scope or period of certification.

Associations are reminded that assessments conducted by other conformity assessment bodies may differ in interpretation or scope. WYAB certification does not validate or supersede assessments performed by other organizations, and such comparisons shall not be implied.

Further Guidance, Authority, and Authorization

Associations and clients are encouraged to seek guidance when engaging with WYAB licensing and certification activities. The authority exercised by WYAB is limited to that delegated by the association for the purpose of certification administration. WYAB does not confer, imply, or guarantee any legal, governmental, official, or statutory authority, rights, or privileges beyond those expressly stated.

Associations shall not state, imply, or allow it to be inferred that, by virtue of WYAB enrollment or certification, they act with the approval, endorsement, or authorization of the Government of the United Kingdom or any other governmental or regulatory authority in any country or jurisdiction.

Regulation

WYAB activities are governed by the laws of England and Wales. WYAB shall not be held liable for any outcomes, costs, losses, or damages arising from changes in legislation, regulations, or governmental instruments, or from the interpretation or implementation of such legal requirements that may affect WYAB activities.

Payments and Installments

WYAB requires enrolled associations to pay all applicable fees in advance or through an approved payment method, documented in writing, in order to maintain their enrollment and the certification status of their affiliated organizations.

Comprehensive Framework for Research Facilities and Certification Bodies

In today’s globalized and quality-driven environment, laboratories and product certifiers play a critical role in ensuring that products, systems, and services meet defined standards of safety, performance, and reliability. To maintain consistency, credibility, and trust, it is essential that such organizations operate within a structured framework governed by clearly defined terms and conditions. The following document outlines an extensive and detailed framework for laboratories, research facilities, clinical laboratories, and product certifiers operating under the authorization body for conformity assessment, hereinafter referred to as WYAB.

This comprehensive guide establishes the contractual, operational, and regulatory expectations required for maintaining authorization and certification status. It ensures alignment with internationally recognized standards, promotes transparency, and safeguards the interests of all stakeholders involved.

1. Framework of the Board

The governance framework established by WYAB serves as the backbone of its authorization and certification processes. All laboratories, research institutions, clinical laboratories, and product certifiers—collectively referred to as “associations”—must formally agree to adhere to WYAB’s contractual requirements, administrative procedures, and operational methodologies.

These frameworks are designed in accordance with internationally accepted standards, including ISO/IEC 17025 for testing and calibration laboratories, ISO/IEC 17065 for product certification bodies, and ISO 15189 for medical laboratories. Additionally, all systems must align with the overarching quality management principles outlined in ISO 9001.

The purpose of this alignment is to ensure that all authorized entities operate with a consistent level of quality, reliability, and technical competence. Associations must implement structured processes for documentation, quality assurance, risk management, and continuous improvement.

WYAB requires certified associations to provide adequate and verifiable evidence of conformity whenever requested. This evidence may include audit reports, technical documentation, calibration records, validation data, and other supporting materials. Failure to provide sufficient evidence may result in additional assessments or surveillance visits.

Such additional assessments are subject to fees at prevailing rates. Unless otherwise agreed in writing, the standard rate is USD 2.50 per minute, with a typical assessment day defined as 195 minutes plus an additional 20 minutes allocated for administrative procedures. This structured time allocation ensures consistency and fairness in evaluation practices.

2. Use of Logos and Certification Statements

The use of the WYAB logo and certification statements is a privilege granted only after formal authorization has been issued. Associations must ensure that such usage is accurate, transparent, and strictly limited to the scope of certification granted.

The logo may only be applied to products, systems, or services that have been formally assessed and approved under WYAB certification schemes. Any misuse, including application beyond the approved scope or in a misleading context, is strictly prohibited.

Associations must not imply that certification extends to areas or services that have not been evaluated. Misrepresentation can lead to severe consequences, including suspension or termination of authorization.

Furthermore, the use of third-party certification marks or symbols—such as generic quality icons or misleading visual indicators—in conjunction with WYAB certification is not permitted unless explicitly approved. This ensures clarity and prevents confusion among clients and stakeholders.

All intellectual property rights related to certification activities, including logos, documentation, reports, and methodologies, remain the exclusive property of WYAB unless otherwise agreed in writing. Any materials developed during the certification process are considered part of WYAB’s jurisdiction and must be handled accordingly.

3. Warning and Notifications

Laboratory and Product Certifiers Terms 2

Effective communication is essential for maintaining compliance and addressing issues in a timely manner. WYAB requires that all notices, warnings, and communications related to certification or compliance be documented in writing.

Such notices must be formally issued and endorsed by the appropriate authority within WYAB or the concerned association. Accepted methods of communication include hand delivery, registered post, or prepaid recorded delivery services.

To ensure clarity and legal validity, a notice is deemed to have been received within a specified timeframe. For communications within the same jurisdiction, receipt is assumed 70 hours after dispatch. For international communications, a period of 10 days is considered sufficient for delivery.

Proof of dispatch, such as postal receipts or courier confirmations, serves as valid evidence that the notice has been properly issued. This structured approach minimizes disputes and ensures accountability in communication.

4. Termination of Authorization and Enrollment

WYAB retains full authority to withdraw authorization from any association that fails to comply with established terms and conditions. Authorization is not a permanent entitlement but a conditional status based on continued compliance.

In the event of termination, the association is required to immediately cease all use of the WYAB logo and any related certification statements. This includes removing references from websites, marketing materials, reports, certificates, and any other public or internal documents.

Additionally, WYAB may require the association to delete or amend records that suggest continued authorization. This ensures that stakeholders are not misled regarding the certification status of the organization.

Termination may result from various factors, including non-compliance with standards, failure to provide required documentation, misuse of certification marks, or non-payment of fees. The decision to terminate authorization is made after careful consideration and, where applicable, prior warnings or corrective action requests.

5. License and Scope of Certification

Licenses issued by WYAB are specific and limited in scope. They apply only to the activities, products, or services explicitly listed in the agreement between WYAB and the association, typically detailed in an official index or annex.

Certification indicates that the association has demonstrated compliance with relevant standards at the time of assessment. However, it does not imply blanket approval of all operations conducted by the organization.

Associations must clearly understand that certification is both scope-specific and time-bound. Continued compliance must be demonstrated through periodic assessments, surveillance audits, and renewal processes.

It is also important to note that certification by WYAB does not override or replace evaluations conducted by other conformity assessment bodies. Different organizations may interpret standards differently or apply varying assessment methodologies. Associations must avoid making comparative claims that could misrepresent the value or scope of WYAB certification.

6. Further Guidance, Authority, and Authorization

WYAB encourages associations and clients to seek clarification and guidance when engaging in certification activities. Transparency and communication are key to maintaining effective relationships and ensuring compliance.

The authority exercised by WYAB is strictly limited to certification administration and related activities. It does not extend to granting legal, governmental, or statutory authority.

Associations must not imply that their certification confers any form of government approval or regulatory endorsement. This includes avoiding statements that suggest affiliation with governmental bodies or international regulatory authorities unless such relationships are formally established and documented.

Misrepresentation in this regard can have serious legal and reputational consequences. Associations are responsible for ensuring that all communications accurately reflect the scope and nature of their certification.

All activities conducted under WYAB authorization are governed by the legal framework of England and Wales. This includes contractual agreements, dispute resolution, and interpretation of terms and conditions.

WYAB shall not be held liable for any losses, damages, or consequences arising from changes in laws, regulations, or governmental policies. Associations are responsible for staying informed about relevant legal requirements in their respective jurisdictions.

Changes in legislation may impact certification requirements, operational practices, or compliance obligations. WYAB may update its policies and procedures to reflect such changes, and associations are expected to adapt accordingly.

8. Payments and Installments

Financial compliance is a critical component of maintaining authorization status. WYAB requires all associations to pay applicable fees in advance or through an approved payment arrangement.

Payment terms must be documented in writing and agreed upon by both parties. Failure to meet financial obligations may result in suspension or termination of certification.

Fees may include application charges, assessment costs, surveillance audit fees, renewal charges, and any additional expenses incurred during the certification process.

Maintaining up-to-date payments ensures uninterrupted certification status and continued access to WYAB services. Associations are encouraged to implement internal financial controls to manage these obligations effectively.

9. Continuous Compliance and Improvement

Beyond initial certification, associations are expected to demonstrate ongoing compliance with applicable standards. This involves regular internal audits, management reviews, corrective actions, and continuous improvement initiatives.

WYAB may conduct periodic surveillance assessments to verify continued adherence to requirements. Associations must cooperate fully during such evaluations and provide all necessary documentation and access.

Continuous improvement is a core principle of quality management systems. Associations are encouraged to adopt innovative practices, invest in training, and enhance their technical capabilities to maintain competitiveness and credibility.

10. Ethical Conduct and Professional Responsibility

All associations operating under WYAB authorization must uphold the highest standards of ethical conduct and professional integrity. This includes maintaining impartiality, avoiding conflicts of interest, and ensuring confidentiality of client information.

Certification activities must be conducted objectively and without undue influence. Associations must establish mechanisms to identify and mitigate potential risks related to bias or unethical practices.

Confidentiality agreements and data protection measures must be implemented to safeguard sensitive information. Any breach of confidentiality may result in disciplinary action, including termination of authorization.

11. Documentation and Record Management

Laboratory and Product Certifiers Terms

Accurate and accessible documentation is essential for demonstrating compliance and facilitating assessments. Associations must maintain comprehensive records of all activities related to certification, testing, calibration, and quality management.

Records must be stored securely and be readily retrievable when required. This includes maintaining audit trails, version control, and proper archiving procedures.

Digital systems may be used for record management, provided they meet security and integrity requirements. Proper documentation ensures transparency and supports effective decision-making.

12. Conclusion

The terms and conditions outlined in this document provide a robust framework for laboratories and product certifiers operating under WYAB authorization. By adhering to these guidelines, associations can ensure compliance with international standards, maintain credibility, and deliver reliable services to their clients.

This framework emphasizes accountability, transparency, and continuous improvement, which are essential for sustaining trust in conformity assessment activities. Associations are encouraged to fully understand and implement these requirements to achieve long-term success and recognition in the global marketplace.
